Terms of Service for Calandus

1. Introduction

These Terms of Service (“Terms”) govern your use of the Calandus calendar synchronization service (“Service”) operated by Toppin AS (“we”, “us”, or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

2. Service Description

Calandus is a calendar synchronization and display service that allows users to:

  • Connect and synchronize Google Calendar data
  • Display calendar information on screens and devices
  • View weather information and other widgets
  • Manage multiple calendars in a unified display

3. Account Registration

3.1 Eligibility

You must be at least 16 years old to use this Service.

3.2 Account Terms

  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account
  • You are responsible for all activities that occur under your account
  • One account is intended for use by one household
  • You must notify us immediately of any unauthorized use of your account

3.3 Account Sharing

Your Calandus account is licensed for use by a single household. You may not share your account credentials with individuals outside your household or resell access to the Service.

4. Subscription and Payment

4.1 Free Trial

We may offer a free trial period for new users. At the end of the trial period, you must subscribe to a paid plan to continue using the Service.

4.2 Subscription Plans

  • Subscriptions are billed on a yearly basis
  • Prices are subject to change with 30 days notice
  • All prices are inclusive of applicable taxes unless otherwise stated

4.3 Payment

  • Payment is due at the start of each subscription period
  • We accept payment methods as displayed during checkout
  • Failure to pay may result in suspension or termination of your account

4.4 No Refunds

All subscription payments are non-refundable. We encourage you to use the free trial to evaluate the Service before subscribing.

4.5 Cancellation

You may cancel your subscription at any time. Your access will continue until the end of your current billing period, after which your account will be deactivated.

5. Hardware Devices

5.1 Device Purchases

Calandus may offer display devices (such as Raspberry Pi-based units) for purchase. These devices are sold separately from the Service subscription.

5.2 Device Warranty

Hardware devices are sold “as-is” unless otherwise specified at the time of purchase. Any applicable warranty terms will be provided with the device.

5.3 Device Returns

Hardware return policies, if any, will be specified at the time of purchase.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Reverse engineer or attempt to extract the source code of the Service
  • Use the Service to transmit malware or harmful code
  • Resell, sublicense, or redistribute the Service without authorization
  • Use automated systems to access the Service in a manner that exceeds reasonable use

7. Google Calendar Integration

7.1 Third-Party Service

The Service integrates with Google Calendar. Your use of Google Calendar is subject to Google’s Terms of Service.

7.2 Authorization

By connecting your Google Calendar, you authorize us to access your calendar data as described in our Privacy Policy.

7.3 Revocation

You may revoke Calandus’s access to your Google Calendar at any time through your Google Account settings.

8. Intellectual Property

8.1 Our Rights

The Service, including its design, features, and content, is owned by Toppin AS and is protected by copyright and other intellectual property laws.

8.2 Your Rights

You retain all rights to your calendar data and content. By using the Service, you grant us a limited license to process and display your data as necessary to provide the Service.

8.3 Trademarks

“Calandus” and the Calandus logo are trademarks of Toppin AS. You may not use these trademarks without our prior written consent.

9. Service Availability

9.1 As-Is Service

The Service is provided “as-is” and “as available” without warranties of any kind, either express or implied.

9.2 No Uptime Guarantee

We do not guarantee any specific level of uptime or availability. We will make reasonable efforts to maintain the Service but may experience downtime for maintenance, updates, or unforeseen issues.

9.3 Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice.

10. Limitation of Liability

10.1 Disclaimer

To the maximum extent permitted by law, Toppin AS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits or revenue
  • Loss of data
  • Business interruption
  • Any damages resulting from service interruptions

10.2 Maximum Liability

Our total liability to you for any claims arising from the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10.3 Essential Purpose

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such cases, our liability shall be limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify and hold harmless Toppin AS, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights

12. Termination

12.1 By You

You may terminate your account at any time by contacting us or using the account deletion feature in the Service.

12.2 By Us

We may terminate or suspend your account immediately, without prior notice, if:

  • You breach these Terms
  • You fail to pay subscription fees
  • We are required to do so by law
  • We discontinue the Service

12.3 Effect of Termination

Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your data in accordance with our Privacy Policy
  • Provisions that by their nature should survive termination shall survive

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by:

  • Posting the updated Terms on our website
  • Sending an email to your registered email address

Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through:

  1. Good faith negotiations between the parties
  2. If negotiations fail, the courts of Norway shall have exclusive jurisdiction

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Toppin AS regarding the Service and supersede any prior agreements.
